Managing E-Verify Cases in WorkBright

What type of E-Verify cases can I manage in WorkBright, and how do I take action?

With the WorkBright E-Verify workflow, you'll have in-app access for the resolution of all E-Verify case statuses.

Case types include Tentative Non-Confirmation (TNC), Photo-Match, Unconfirmed Data, Scan and Upload, and Manual Review. Cases not requiring action will be automatically updated to Closed. This feature allows admins to remain in the WorkBright platform, increasing efficiency and eliminating the need to switch between multiple systems.

For most cases submitted through E-Verify, users can expect updates within 24 hours, ensuring prompt resolution in most cases.

TAKING ACTION

E-Verify is designed for quick and efficient employment verification. Typically, cases are resolved within 24 hours, though complexity might occasionally result in longer processing times.

Click on any of these case types to go directly to that section. Cases not requiring action will be automatically updated to Closed.

Photo-Match

E-Verify photo matching will prompt you to compare the employee’s photo document with the photo displayed when the E-Verify case was created. This helps ensure that the document the employee provided matches DHS records.

The four List A documents that will trigger photo matching are the U.S. passport, passport card, Permanent Resident Card (Form I-551), and Employment Authorization Document (Form I-766). When the employee chooses one of these documents, they will upload the front and back of the document (or, in the case of a U.S. passport, copy the Passport ID page and the Passport Barcode page). If the employee’s Form I-9 information matches records available to DHS, E-Verify displays the employee’s photo from the document presented.

If you select No, this photo does not match, e-Verify will update the case status to Scan and Upload.

Unconfirmed Data

An Unconfirmed Data status means E-Verify could not confirm some of the information from the staff member’s Form I-9 and is asking you to review it. Before you take action, figure out where the incorrect information came from: Section 1 or Section 2 of the Form I-9.

Unconfirmed Data

If the information is correct

Confirm the displayed fields and click Confirm and Send to E-Verify.

If the error is in Section 1

The staff member completes and signs Section 1, so only the staff member can correct it. Section 1 includes name, date of birth, and Social Security number. Do not correct Section 1 information in the displayed fields on the case screen.

  1. Close the open E-Verify case. A new case cannot be created while the current case is still open.

  2. Reject the Form I-9 so the staff member can correct Section 1 and resubmit it.

  3. After the staff member resubmits and completes Section 2, E-Verify creates a new case with the corrected information.

Example: A staff member’s date of birth on their profile does not match the date on their passport. Date of birth is part of Section 1, so close the case and have the staff member correct and resubmit the Form I-9.

If the error is in Section 2

Admins complete Section 2, so an admin can correct it. This does not require a new signature from the staff member.

  • Open the staff member’s Form I-9 and use Edit Section 2 to correct the information.

  • A new E-Verify case is created with the corrected information.

Note: Changes made in the displayed fields on the case screen are sent only to E-Verify. They do not update the Form I-9 or the staff profile. Correcting the Form I-9 keeps your records consistent with what E-Verify receives.

Scan and Upload

For cases with a Scan and Upload status, E-Verify requests an image of both the front and back of most requested documents. For a U.S. passport or passport card, E-Verify will request an image of the Passport ID page and the Passport Barcode page.

When viewing a case in the Scan and Upload status, admins can automatically submit the photos the staff submitted of their Form I-9 documentation directly to E-Verify for further review by clicking the "Send photos to E-Verify" button.

Manual Review

For cases requiring manual review, E-Verify will return an 'E-Verify Needs More Time' response and, in most cases, provide a verification result within 24 hours. No action is required by the employer or employee during this time. Employers should check E-Verify regularly for status updates.

In most cases, verification results are provided within 24 hours, ensuring timely processing for manual review cases.

Tentative Non-Confirmation (TNC) Cases

Cases returned from E-Verify as Tentative Non-Confirmation or TNC will appear in the E-Verify Summary on the Dashboard as 'E-Verify case Pending Referral (TNC)".

Clicking on the employee name will open the details of the TNC case.

At this point, the system will notify the staff member that there is an issue with their E-Verify case.

The staff member will log in to the WorkBright platform and will be given the opportunity to review the E-Verify Further Action Notice (FAN), which will indicate where the mismatch occurred in their I-9 data and which agency reported the mismatch: DHS, SSA, or both. From the Staff Action page in WorkBright, the staff member will need to confirm with an administrator if there is an error in Section 1 or Section 2 of their I-9 that generated the TNC mismatch.

If the staff member indicates that their Form I-9 is not correct, you need to take action to either have the staff member resubmit the Form I-9 or edit the Section 2 data and update the Form I-9. These cases will be displayed on the dashboard as E-Verify case Pending Referral Bad Data (TNC).

If the staff member determines that their Form I-9 is correct, they will need to indicate whether they will dispute the mismatch with the agency or agencies listed in the FAN. If selecting “I WILL NOT take action to resolve this mismatch”, that information will be sent to e-Verify, resulting in a Final Nonconfirmation status that you will need to close.

If they choose to take action, the case will be updated to Referred, and the staff member will need to contact the agencies where the mismatch occurred.

The audit trail will display that choice in your administrator view.

Once a case has been referred, an administrator cannot close it. The Close Case option will not be available. The staff member must follow the instructions on their Further Action Notice to resolve the mismatch directly with DHS, SSA, or both. If the staff member does not take action, DHS or SSA will close the case as a no-show after a specified period. You cannot close a referred case early, nor can you submit a new case in its place while it remains open.

Final Nonconfirmation, and you or another administrator will need to provide a closure reason and Close.

Closing a Case

Administrators do not determine or select the result of an E-Verify case. Only E-Verify returns the result. What you provide when closing a case is a case closure reason.

The Close Case option appears only when the case is in a closeable state. If you do not see the option, the case is not closeable yet.

Cases you can close:

  • Cases E-Verify have returned as Final Nonconfirmation.

  • Cases that require a closure reason because employment did not begin or has ended.

Cases you cannot close:

  • Cases in a Referred status. These stay open until DHS or SSA returns a result, or until the agency closes the case as a no-show.

  • Cases still pending a response from E-Verify, including Manual Review.

Cases that do not require action are automatically updated to Closed. You do not need to close these yourself.

Unable to Submit to E-Verify

In some cases, the I-9 cannot be able to be submitted to E-Verify. This will be indicated in the E-Verify status box on the staff Form I-9 page.

These are some of the reasons that this would occur:

  • Missing SSN - the staff member must add their SSN through the dedicated Update Your SSN page. When they complete that page and confirm the disclaimer, the Form I-9 is re-rendered and the case is automatically submitted to E-Verify. Unchecking the awaiting-SSN box or editing the SSN on the staff profile will not resubmit the case.

    Note: A missing SSN is the only reason on this list an administrator cannot resolve directly. Section 1 of the Form I-9 must be completed by the staff member, so the SSN can only be added by the staff member through the Update Your SSN page.

  • Receipt - if the admin edits section 2 and unchecks "receipt" for the document, the I-9 will automatically be resubmitted to E-Verify.

  • Skip E-Verify - if this was toggled ON, then they would have to toggle this OFF and request a new I-9 submission for it to go to E-Verify on countersignature.

  • Open Case - they need to close the open case, and a new I-9 must be submitted for it to go to E-Verify. (See Closing a Case above. If the open case is in a Referred status, it cannot be closed, and a new case cannot be submitted until the agency resolves or closes it.)

  • If there are multiple reasons, it will appear in the E-Verify status box like this.

For some of these reasons, you will be able to use the “Resubmit to E-Verify” button.
